SEO Mastermind: Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs your use of the services provided by SEO Mastermind (seomastermind.org). These services may not be used in any manner that:

  1. Is illegal or promotes illegal acts.

  2. Is non-compliant with accepted industry best practice guidelines.

  3. Disrupts or damages SEO Mastermind's computer systems/networks or those of third parties.

  4. Violates any person’s rights, including privacy and intellectual property.

If you do not agree to this Policy, do not use SEO Mastermind Services.

SEO Mastermind, in its sole discretion, shall determine whether there has been a violation of this Policy and may amend these terms from time to time.

1. Prohibited Uses and Messaging

The following list provides examples of prohibited uses. This list is illustrative and not exhaustive. You are prohibited from using SEO Mastermind Services to:

  • Legal Violations: Engage in messaging that violates relevant laws (including the Telephone Consumer Protection Act and the Telemarketing Sales Rule).

  • Harmful Content: Transmit messaging that is offensive, obscene, libelous, defamatory, fraudulent, abusive, or contains tortious material.

  • Minor Protection: Engage in messaging unsuitable for minors or that collects data from minors without legal consent.

  • Deception: Send false, misleading, or deceptive communications, including misrepresenting healthcare purposes.

  • Intellectual Property: Infringe upon the copyrights, trademarks, or patents of any third party.

  • Opt-Out Compliance: You must honor all "STOP" or opt-out requests immediately. Desist from sending further messages once a request is received. For healthcare, you must maintain HIPAA-compliant processes for the revocation of authorization.

2. HIPAA Compliance & Protected Health Information (PHI)

If you are a Covered Entity or Business Associate subject to HIPAA, the following rules apply:

Mandatory Business Associate Agreement (BAA)

You must have a valid Business Associate Agreement (BAA) executed with SEO Mastermind prior to using the Services for PHI. If no BAA exists, the transmission, storage, or processing of PHI within our services is strictly prohibited.

Permitted Uses of PHI (With a BAA)

If a BAA is in place, you may only process PHI in accordance with:

  • HIPAA Privacy, Security, and Breach Notification Rules.

  • The “minimum necessary” standard.

  • The specific permitted disclosures defined within your executed BAA.

Prohibited PHI Activities

Regardless of whether a BAA is in place, you may not:

  • Use PHI for marketing or promotional messaging.

  • Send PHI to unauthorized individuals.

  • Transmit PHI through third-party integrations or APIs unless they are explicitly approved under the BAA.

  • Use PHI for A/B testing, profiling, or unauthorized analytics.

3. Security and Integrity

SEO Mastermind maintains robust controls aligned with the AICPA Trust Services Criteria for Security. We operate under SOC 2 Type II compliance standards, ensuring our controls are independently audited to protect customer data with the highest levels of integrity.

Violation Consequences

Violation of this Policy may result in the immediate termination or suspension of all services. Furthermore, unauthorized use of PHI without a BAA or suspected HIPAA violations may result in civil, criminal, or administrative penalties against the client and those assisting them.

4. Customer Responsibilities

As the account holder, you are responsible for:

  • Ensuring all workforce members and employees comply with HIPAA and this Policy.

  • Properly configuring access controls, user permissions, and Multi-Factor Authentication (MFA).

  • Verifying that any third-party system used in conjunction with our API is HIPAA-compliant if PHI is involved.

  • Immediate Notification: You must notify SEO Mastermind immediately of any suspected unauthorized access or security incidents.

5. Breach Notification

If SEO Mastermind becomes aware of a potential breach of unsecured PHI, we will notify impacted customers in accordance with the HIPAA Breach Notification Rule and the specific terms of the executed BAA.
